Georgia Life Insurance Laws

Georgia's Office of Insurance and Safety Fire Commissioner enforces life insurance standards under Title 33 of the Georgia Code. Every licensed insurer must meet these minimum consumer protections.

  • Free Look Period: Georgia law gives you 10 days after buying a policy to cancel for a full premium refund.
  • Grace Period: Georgia requires at least a 30-day grace period on all premium payments after the first. Your policy stays in force during that time. Any overdue premium can be deducted from a death benefit paid during the grace period.
  • Contestability Period: After two years from the issue date, insurers cannot contest a policy except for nonpayment of premiums. If a policy lapses and you reapply, the contestability period restarts from the new effective date.
  • Reinstatement Right: If your policy lapses for nonpayment, you have three years from the date of default to request reinstatement in writing. Reinstatement requires proof of insurability and payment of any past-due premiums and accrued interest.
  • Claims Payment Deadline: After a beneficiary submits proof of death, the insurer must pay the claim. Any claim unsettled after 30 days accrues interest from the date of death.
  • Minor Eligibility: Minors aged 15 or older may buy life insurance on themselves or on someone with whom they have an insurable interest, without a parent or guardian's signature.
  • Guaranty Association Protection: If your insurer becomes insolvent, the Georgia Life & Health Insurance Guaranty Association covers up to $300,000 in death benefits and $100,000 in cash surrender value. Membership is mandatory for every insurer licensed in Georgia.
