Virginia Life Insurance Laws
Virginia life insurance law falls under Title 38.2 of the Code of Virginia and is enforced by the Bureau of Insurance (BOI). The BOI licenses insurers, approves policy forms and investigates consumer complaints. Virginia life insurance law gives you several consumer protections that most states don't match, including one of the longest free look periods in the country for buyers over 65.
- Free look period: Virginia gives you 10 days to review a new life insurance policy and cancel for a full refund. If you're 65 or older, that window is 20 days.
- Grace period: After your first payment, every individual life insurance policy must include at least 31 days to make subsequent premium payments. You won't lose coverage over a single late bill.
- Contestability period: Once your policy has been active for two years from its issue date, your insurer can no longer contest it. Nonpayment of premiums is the only exception.
- Misstatement of age: An age error on your application won't void your policy, but it will change your payout. Your insurer adjusts the death benefit to reflect what your premiums would have bought at your correct age.
- Guaranty association protection: The Virginia Life, Accident and Sickness Insurance Guaranty Association steps in if a licensed insurer becomes insolvent, covering up to $300,000 in lost death benefits and $100,000 in lost cash surrender value.
- Claim acknowledgment: After you file a claim, your insurer has 15 calendar days to confirm it was received.
- Unfair practices prohibition: Virginia adopted the Unfair Claims Settlement Practices Act, which bars insurers from using deceptive or bad-faith practices when handling claims.
