Workers' comp insurance provides benefits to employees for workplace injuries without requiring them to prove their employer did anything wrong. The coverage pays for doctor visits and treatment, replaces part of an employee's paycheck during recovery and supports their return to work.

While workers' comp protects businesses from injury-related lawsuits and gets injured workers the help they need quickly, specific rules determine what's covered, such as what counts as work-related and who qualifies for coverage.

How Does Workers' Comp Insurance Work?

Workers' comp policies cover injuries that happen during the policy period, regardless of when claims are filed. An injury from January can be reported in March and still be covered, though most states require reporting within 30 to 90 days.

Each state's workers' compensation schedule sets benefit amounts for injured employees. Two factors determine the calculation: injury severity and the employee's average weekly wage. Together they set the benefit amounts for medical treatment, wage replacement and related costs.

An example: A construction worker earning $1,000 a week suffers a back injury and can't work for three months. Benefits are calculated as follows:

  • The state assigns a disability rating based on injury severity and its effect on the worker's ability to perform their job
  • Most states replace 60% to 70% of average weekly wages (in this case, $600 to $700 a week during recovery)
  • The schedule determines how long benefits last based on whether the disability is temporary or permanent

Benefit amounts are set by state law, not negotiated case-by-case. Your insurer processes the claims and pays benefits according to your state's schedule under Part A (workers' compensation coverage). The exception is Part B (employers' liability coverage), where you choose limits that cap lawsuit-related payouts.

Employees are typically people whose work you direct and control: you set their hours, provide tools, and determine how tasks get done. Independent contractors (1099 workers) usually control their own schedule and methods, so your policy often doesn't cover them.

Part B: Employers' Liability Coverage

Part B, also called employers' liability, protects your business when employees or third parties sue you for workplace injuries that fall outside Part A coverage.

What Does Workers' Comp Insurance Not Cover?

Workers' comp excludes injuries that aren't work-related, situations involving employee misconduct and cases where the connection to work is unclear.

  • Non-work-related injuries: Injuries that happen outside work hours, off company property or during personal activities, even when the employee was technically on the clock
  • Intoxication-related injuries: Injuries that occur when an employee is under the influence of drugs or alcohol, particularly when intoxication was a contributing factor
  • Employee misconduct: Intentional self-harm, fabricated or exaggerated claims, injuries during criminal activity and injuries from fighting or horseplay unrelated to work duties
  • Location and timing gray areas: Commuting to and from work generally doesn't qualify unless travel is between job sites or in a company vehicle. Break-time injuries depend on whether the employee was on premises and whether the activity benefited the employer. Remote work injuries require that the injury occurred during work hours, in a designated workspace and in the course of performing job duties.
  • Medical complexity cases: Pre-existing conditions aggravated by work and gradual-onset injuries like repetitive stress or occupational illness both require demonstrating that work was the primary cause.
  • Independent contractor misclassification: When someone classified as a contractor is later determined to be an employee, coverage questions become complicated.
